Terms

Updated October 19, 2026

01

Agreement

These terms are a contract between you and Driftrail (“Driftrail,” “we,” “us,” and “our”) covering the FreeSyntax website, accounts, shop, membership, access codes, credits, hosted model features, and related support. The site is published at freesyntax.dev. The product name is notch. By creating an account, buying something, redeeming a code, sending a hosted request, or otherwise using those offerings, you agree to these terms. If you do not agree, do not create an account and do not buy through the site.

The notch desktop is published under the GNU Affero General Public License version 3 only. The notch command-line tool is published under the Apache License 2.0. Third-party components keep the licenses shipped with them. Those licenses govern the software itself: the right to run, study, modify, and share it, and the conditions that come with sharing. These terms do not narrow the rights those licenses grant you in the software, and they do not add a fee for exercising those rights. These terms do govern the website, accounts, payments, hosted features, gear, and the promises we do and do not make around them.

If you use the desktop or CLI as part of a hosted or paid feature, both the software license and these terms can apply at once, each to its own subject. If a mandatory consumer-protection law in your place gives you a right these terms cannot waive, that right still applies. The rest of these terms continue to apply.

Support, legal notices, and privacy requests go to support@driftrail.com. Mail we send about an order or an account may show a from-address on freesyntax.dev. The mailbox that binds us for a notice under these terms is support@driftrail.com.

02

Who may use the service

You must be at least 18 years old, and able to form a binding contract, to create an account, buy gear, subscribe, redeem a code, or use a hosted feature. If you use the service for a company or another organization, you represent that you have authority to bind that organization, and “you” includes both you and that organization. The organization is responsible for the people it allows to use its account.

You may not use the service if a law that applies to you prohibits that use, if you are on a denied-party list that applies to us, or if we have previously closed your account for a serious breach and you have not received written permission to return. We may refuse an account, an order, or a request.

03

The software on your machine

You may run the desktop and CLI on your own machine without an account. Projects, chats, settings, undo history, and downloaded models stay on that machine. The local edition does not send those files to us. We do not operate your computer, and we do not accept custody of a local project.

The tools can read, write, and run commands in folders you point them at, subject to the permissions you set. You are responsible for reviewing changes before you rely on them, for keeping work in version control, and for not pointing the tools at a folder that contains secrets you are not willing to have a model or a command see. Undo and checkpoints are a convenience inside the product. They are not a backup, they do not cover every action a shell or a plugin can take, and they are not a promise that a file can be restored.

Windows installers published today are unsigned. Windows or your browser may warn before the file runs. That warning is a property of an unsigned download, not a statement that we have certified the file to Microsoft. Download the installer only from the GitHub release linked on freesyntax.dev, and compare the published SHA-256 if you want to check that the bytes match the release. We are not responsible for a build you obtain from anywhere else, for a file that has been modified after publication, or for a decision by Windows, an employer, or security software to block the installer.

Releases are provided as they are built. We may publish a fix, and we may stop publishing builds for a platform. A copy you already have keeps the open-source license it was published under. That license, not these terms, sets your obligations if you modify the desktop and offer it to others over a network, or if you redistribute the CLI.

04

Accounts

You are responsible for the credentials on your account, for every action taken with them, and for keeping them confidential. Tell us at support@driftrail.com if you believe the account is being used without your permission. We may suspend or close an account that breaks these terms, that we reasonably believe is compromised, or that is used to defraud us or anyone else. We may require a fresh sign-in, a code, or another check before a sensitive change.

An account is for you or for the organization that owns it. You may not sell it, share the login, or let a third party operate it as a reseller of the hosted service. We may limit how many sessions, keys, or requests an account may have.

Information you submit to open or maintain an account must be accurate enough for us to reach you about a charge, a shipment, or a security event. A false identity used to obtain a paid feature or to evade a ban is a breach.

05

Acceptable use

You agree not to use the site, an account, a code, or a hosted feature to:

  • —Break the law, or help someone else break the law.
  • —Harm people, or attempt to gain access to systems, accounts, or data you do not have permission to access.
  • —Develop, share, or deploy malware, exploits, or code whose purpose is unauthorized access or damage.
  • —Generate or distribute child sexual abuse material, or any sexual content involving a minor.
  • —Circumvent rate limits, billing, authentication, or access controls, or probe the service for a vulnerability except through a private report to support@driftrail.com.
  • —Resell, sublicense, or publicly broker access to the hosted service, member downloads, or an account, unless we agree in writing.
  • —Overload the site, scrape it in a way that degrades it, or bypass a technical limit.
  • —Upload a virus or other harmful code to the website, or interfere with other people’s accounts.
  • —Misrepresent the origin of model output as human work where the law or a duty to someone else requires disclosure, or use output to deceive a person about who they are dealing with.
  • —Use the service to send unlawful spam, or to collect personal data about other people without a lawful basis.

The open-source licenses still let you run and modify the desktop and CLI on your own machines. This section restricts abuse of the website, the account system, and hosted features. It is not a ban on ordinary security work you are authorized to do in your own projects. A vulnerability in our website or hosted service should be reported privately to support@driftrail.com so we can fix it before it is public. Do not access other customers’ data to demonstrate a problem.

We may investigate a suspected breach, remove content, revoke a code, and cooperate with a lawful request from a public authority. We may preserve related logs for that investigation beyond the ordinary retention period described in the privacy policy.

06

Model output

Code, text, and other output from a model are generated as the model produces them. They can be wrong, incomplete, insecure, biased, or similar to material the model was trained on. They can omit a license header that the underlying material required. They are not a substitute for your own review, tests, and judgment.

Output is not legal, financial, medical, security, or other professional advice. It does not create a professional relationship between you and Driftrail. You are solely responsible for reviewing, testing, and deciding whether to use output, including in a production system, a customer deliverable, or a regulated setting. You assume the risk that output infringes someone else’s rights, introduces a defect, or leaks a secret you placed in the prompt.

We do not claim ownership of output generated for you. We also do not assign you any rights in output that we do not ourselves have. Similarity to a third party’s work, a patent, or a trademark is your problem to clear before you ship it. The same is true of a FreeSyntax model weight you download: the weight’s own license controls what you may do with that weight, and these terms do not grant a patent license or a trademark license.

A local model runs on your machine under the runtime you install. A hosted model runs only for the request you submit. Neither is a guarantee of fitness for a particular codebase, a particular machine, or a particular result.

07

Your content

You keep the rights you already have in files on your machine, in repositories you own, and in text you submit. You represent that you have the rights needed to submit that material to a hosted feature and, if you turn on a provider, to send it to that provider.

For material you submit to a hosted feature, you grant Driftrail a worldwide license to host, reproduce, transmit, and display that material only as needed to provide the feature, to meter and bill it, to secure the service, to comply with law, and to enforce these terms. The license ends when the material is deleted from our systems, except for copies in ordinary backups until they expire, and except for copies a provider you selected already received under its own terms. We do not acquire a license to train on that material unless you explicitly opt in.

You are responsible for the content you submit. We do not undertake to monitor every prompt. We may remove or refuse material that we reasonably believe breaches these terms or the law, and we have no liability for doing so or for failing to do so.

08

Membership, downloads, and hosted compute

Membership, where offered, is a paid entitlement to the features described at the time you buy it. Those features can include local download of designated FreeSyntax model weights and access to hosted compute at the stated rate. A membership does not transfer ownership of any model, the brand, the site, or the software. It is not an investment and it is not equity.

Pyre, Solace, Ignis, and any other FreeSyntax weights we offer are member downloads for local use unless a separate written agreement says otherwise. We do not promise to host those weights as a first-party inference service. Each weight’s own license, and the license of any upstream model it is derived from, applies to the file you download. Availability of a weight can end if the upstream license, a legal demand, or a technical limit requires that. A download you already completed remains subject to the license that applied when you downloaded it. We are not the licensor of third-party weights you fetch yourself from Hugging Face or another host.

Platform-paid inference, when it is available, is charged at the underlying provider’s cost plus 5%, unless the page where you confirm the charge states a different rate. When we mediate a bring-your-own-key call, we charge a 2% processing fee for that mediation, and your provider bills the rest. Rates, limits, and which models are offered can change. The rate shown before you confirm a charge is the rate for that charge. A key you supply must be yours to use. You are responsible for the provider bill that key incurs, including charges caused by a bug, a retry, or a prompt you sent.

Credits or balances, if your account has them, have no cash value, are not a bank deposit, and are not transferable. They may be applied only to eligible charges on the service. If we close an account for breach, unused credits may be forfeited. If you close an account yourself, unused credits are not refunded except where the law requires a refund.

We may set rate limits, concurrency limits, and fair-use limits. A limit is part of the service, not a defect. We may throttle or stop traffic that threatens the stability of the service or that looks like resale or automation beyond what the plan allows.

09

Gear and other goods

Physical goods offered on the shop, including hats and any later apparel, are sold by Driftrail as described on the product page at the time of the order. Colors and photographs are approximate. Checkout shows the price, the destinations we ship to, and whether shipping is included. An order is accepted when we send a confirmation. We may cancel an order we cannot fulfill, including after a payment authorization, and we will refund the charge for that cancelled order.

Risk of loss passes when the carrier receives the parcel, except where the law keeps that risk with us until delivery. Title passes on delivery, except where the law says otherwise. You are responsible for a correct shipping address and for any duty or import charge your country assesses. A delivery problem should be reported to support@driftrail.com within a reasonable time after the expected delivery date, with the order reference.

Goods are provided as described. Where a non-waivable consumer law gives you a repair, replacement, or refund right for a faulty good, that right remains. Outside those rights, we do not warrant that apparel will meet a particular use, and ordinary wear is not a defect.

10

Fees, taxes, and refunds

You agree to pay the fees you confirm, plus applicable taxes. Stripe processes the card. You authorize us and Stripe to charge the payment method you provide, including for a renewal if you start a subscription that renews. A subscription continues until you cancel it. Cancellation stops the next renewal. It does not refund a period that has already started, except where the law requires a refund.

Fees are stated before you confirm the charge. Except where a non-waivable law requires a refund, or where these terms expressly promise one, fees are non-refundable. We may, at our discretion, refund or credit a charge that resulted from a verified error on our side. A refund is made to the original payment method when Stripe can do so.

You are responsible for taxes that apply to you other than taxes on our own income. If a charge fails, we may suspend the paid feature until it succeeds. If you dispute a charge with your bank without writing to support@driftrail.com first, and the dispute is not resolved in your favor, we may suspend the account and recover the reasonable cost of responding to the dispute. Contacting us first does not waive a right you have under card-network rules or consumer law.

Prices can change for future purchases and future renewal periods. We will not change the price of a charge you have already confirmed. If a subscription price increases, the new price applies to the next renewal after we give the notice the law requires.

11

Intellectual property and feedback

The FreeSyntax name, the notch name, the site design, and the logos are ours or are licensed to us. These terms do not grant a trademark license. You may refer to the product by its name in a truthful description, including to say that you use it. You may not use the names or logos in a way that suggests we sponsor or endorse you, and you may not register a confusingly similar name.

The open-source licenses named above are the permission to use, modify, and share the desktop and CLI source and binaries we publish. Copyright notices and license texts that ship with the software must stay with the copies those licenses require them to stay with. Third-party components, including a runtime, a model weight, and a search tool bundled with a release, remain under their own notices.

If you send us a suggestion, a bug report, or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose, including improving the product, without any duty to pay you or to keep it confidential. Do not send feedback that you consider a trade secret. This license does not apply to source code you submit under a contributor license or a pull request that states a different license. It does not apply to personal information, which the privacy policy covers.

12

Third-party services

The service depends on suppliers and, when you choose them, on model providers, GitHub, Hugging Face, payment networks, and carriers. Their acts and outages are outside our control. Your use of a provider key, a sign-in method, or a download host is also a relationship between you and that party. We are not responsible for their fees, their data practices, their output, or their decision to suspend you.

A link on the site, including a link to a release or a model card, is not an endorsement of everything at that destination. Model cards and upstream licenses can change. You are responsible for reading the license of a weight before you use it in a product you ship.

13

Changes, preview, and availability

We may change, pause, or remove a hosted feature, a plan, a weight available for new downloads, or a page of the site. We do not promise a particular uptime, a particular model, or a particular response time. Hosted inference depends on the providers behind it and on capacity. Maintenance, abuse response, and supplier failures can interrupt the service.

A feature marked preview, beta, or experimental is less reliable than the rest of the service. It may change or disappear, and it is included in the disclaimers below without any higher duty of care. Preview software, including an unsigned Windows build, is offered so you can try it, not as a warranted product.

We may discontinue the hosted service. If we discontinue a subscription feature you have prepaid, we will refund the unused portion of that prepayment where the law requires it, or where we choose to do so. Discontinuation does not revoke the open-source license on a copy of the desktop or CLI you already received.

14

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, ACCOUNTS, MEMBERSHIP, HOSTED FEATURES, DOWNLOADS WE OFFER, DOCUMENTATION, AND SUPPORT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” DRIFTRAIL DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, NON-INFRINGEMENT, AND ANY WARRANTY THAT ARISES FROM A COURSE OF DEALING OR USAGE OF TRADE.

Without limiting that disclaimer, we do not warrant that the service will be uninterrupted, timely, secure, or error-free; that model output will be accurate, original, or safe to run; that a local install will be compatible with your machine; that a weight will fit in your memory or produce a useful result; that defects will be corrected; or that a third-party provider, carrier, or host will perform. You download unsigned software and model weights at your own risk. Some jurisdictions do not allow an exclusion of implied warranties, so some of the exclusions above may not apply to you. They apply to the fullest extent they are allowed to apply.

15

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIFTRAIL AND ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, COVER, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS INTERRUPTION, WHETHER AN ACTION IS IN CONTRACT, TORT, OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY. THIS INCLUDES DAMAGES FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, FROM MODEL OUTPUT, FROM A FILE THE SOFTWARE CHANGED OR FAILED TO RESTORE, FROM UNAUTHORIZED ACCESS TO AN ACCOUNT OR A PROMPT, FROM A THIRD-PARTY PROVIDER, AND FROM A GOOD THAT IS DELAYED OR LOST IN CARRIAGE EXCEPT WHERE THE LAW FORBIDS THIS LIMIT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THAT PERIOD OR ONE HUNDRED U.S. DOLLARS (US $100). THIS CAP IS AN AGGREGATE CAP, NOT A CAP PER CLAIM. IF THE LAW DOES NOT ALLOW A CAP THAT LOW, THE CAP IS THE SMALLEST AMOUNT THE LAW ALLOWS.

The limits in this section do not apply to liability that the law does not allow us to limit, including liability for our fraud or willful misconduct, or for death or personal injury caused by our negligence where that exclusion is prohibited. They do apply to everything else, including negligence that the law allows parties to limit. You acknowledge that the fees reflect this allocation of risk. If you do not want to bear that risk, do not use the hosted service and do not rely on model output.

16

Indemnity

You will defend, indemnify, and hold harmless Driftrail and its directors, officers, employees, contractors, and agents from and against any third-party claim, demand, loss, damage, liability, cost, and expense, including reasonable attorneys’ fees, arising out of or related to: your use of the hosted service or of model output; your content; your breach of these terms; your violation of a law or of a third party’s rights; a dispute between you and a person who relied on output you shipped; or your use of a provider key, a downloaded weight, or a remote system you did not have the right to use.

We will give you prompt notice of a claim we want you to cover, provided that a delay in notice relieves you only to the extent you are materially prejudiced. You may not settle a claim in a way that admits fault by us, imposes a duty on us, or limits our rights, unless we agree in writing. We may participate in the defense with our own counsel at our own expense. This indemnity is in addition to the liability limits above, and it survives the end of your account.

17

Termination

You may stop using the site and close your account at any time by writing to support@driftrail.com. We may suspend or close an account, revoke a code, or stop a hosted feature immediately if you breach these terms, if we are required to by law, or if continuing the account creates a security or legal risk. We will tell you when it is reasonable to do so. We do not have to give advance notice of a suspension for fraud, abuse, or a serious security incident.

When access ends, your right to use hosted features and the account ends. Sections that by their nature should survive do survive, including the sections on model output, your content, intellectual property, feedback, disclaimers, limitation of liability, indemnity, disputes, and this sentence. Ending an account does not end the open-source license on a copy of the software you already have, and it does not require us to keep hosting your prompts. How personal information is deleted is described in the privacy policy.

18

Disputes

Write to support@driftrail.com first and describe the dispute, the account email, and what you want. Give us 30 days to try to resolve it before you start a formal proceeding, unless the law gives you a shorter window you cannot extend, or unless you need urgent injunctive relief to stop misuse of intellectual property or unauthorized access.

These terms are governed by the laws of the place where Driftrail is established, without regard to conflict-of-law rules that would send the dispute somewhere else. The courts of that place have exclusive jurisdiction, except where a consumer-protection law gives you a court you cannot waive, and except that we may seek injunctive relief in any court that has jurisdiction for misuse of the brand, the site, or an account. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

To the extent the law allows, each party waives any right to a jury trial, and you agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in a class, collective, or representative proceeding. If a waiver of class proceedings is held unenforceable for a particular claim, that claim may proceed only to the extent required for the waiver to be severed, and the rest of this section still applies.

19

Export and sanctions

You represent that you are not located in a country or territory subject to a comprehensive embargo that applies to this service, and that you are not a denied party under applicable export or sanctions rules. You will not use, export, or re-export the hosted service or a download in violation of those rules. Model weights and encryption features may be subject to export control. You are responsible for determining whether your own shipment of software or weights to someone else requires a license.

20

Other terms

These terms, together with the privacy policy and the open-source licenses that ship with the software, are the entire agreement between you and Driftrail about their subject. They replace earlier oral or written statements about the hosted service and the site. A purchase order or vendor form you send does not change these terms unless we sign it.

If a provision is held unenforceable, it is modified to the minimum extent required to make it enforceable, and the rest remains in effect. A waiver is effective only if it is in writing and only for the specific breach waived. A delay in enforcing a right is not a waiver. You may not assign these terms or an account without our written consent. We may assign them to an affiliate or to a successor of the business. These terms bind permitted successors.

We are not liable for a failure or delay caused by a circumstance beyond our reasonable control, including a provider outage, a network failure, a labor dispute, a natural disaster, a war, or a change in law. Nothing in these terms creates a partnership, joint venture, or employment relationship. There are no third-party beneficiaries, except the people protected by the limitation of liability and the indemnity, who may enforce those protections.

Headings are for convenience. The word “including” means “including without limitation.” A reference to a law includes that law as it changes. Notices to you may be sent to the email on the account, and they are deemed received when sent unless we receive a bounce. Notices to us must be sent to support@driftrail.com and are deemed received on the next business day after we receive them.

21

Changes to these terms

We may update these terms by posting a new version on this page and changing the date at the top. If a change is material, we will provide any additional notice the law requires, which may include email to the address on the account. The new terms apply to use of an account or a paid feature after the effective date. If you do not agree to a material change, stop using the hosted service and close the account before the effective date. The open-source license on software you already received is not revoked by a change to these terms.

Questions about these terms go to support@driftrail.com. Please include the account email and, for an order, the order reference.
